These Terms of Business govern the relationship between Thane Property Investments Ltd ("we", "us", "our") and our clients. By instructing us to provide property services, you agree to these terms.
1. Definitions
- "Client" means any person, company, or entity who instructs us to provide services
- "Property" means any residential property that is the subject of our services
- "Services" means estate agency, valuation, or related services
2. Our Services
We provide the following services:
- Sales: Marketing and selling residential properties on behalf of vendors
- Valuations: Market appraisals and formal valuations
- Acquisitions: Assisting buyers in finding and purchasing properties
3. Fees and Commission
Our fees are agreed in writing before any services commence:
- Sales Commission: 1.0% of the final sale price, payable on completion. No sale, no fee.
- Valuations: Free for standard market appraisals; formal valuations priced separately
As a new agency, we have not yet reached the HMRC VAT threshold. Until we do, our fee is a flat 1% of the sale price. For standard sales instructions, no fee is payable unless a sale completes. Other arrangements may be agreed in writing.
4. Client Obligations
You agree to:
- Provide accurate and complete information about the property and your circumstances
- Inform us immediately of any changes that may affect the transaction
- Not instruct another agent to sell or let the same property during our sole agency period without our written consent
- Pay our fees promptly when due
5. Anti-Money Laundering
We are required by law to verify the identity of all clients. We will request proof of identity and address before proceeding with any transaction. Failure to provide satisfactory documentation may result in us declining or terminating our services.
6. Complaints
If you are dissatisfied with our service, please contact us in the first instance. We have a formal complaints procedure detailed on our Complaints Procedure page. If we cannot resolve your complaint, you may refer it to The Property Ombudsman.
7. Limitation of Liability
Our liability is limited to the fees paid for the specific service in question, except where prohibited by law. We are not liable for any indirect, consequential, or economic loss.
8. Governing Law
These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
